Terms of Use

These Terms of Use ("Terms") are an agreement between you and MUSKOX LLC ("MUSKOX," "we," "us," or "our") about your use of muskoxmn.com and any page that links to these Terms (the "Site").

By using the Site, you agree to these Terms. If you don't agree, please don't use the Site. If you use the Site on behalf of a company, you agree to these Terms for that company and confirm you have authority to do so.

Section 13 requires most disputes to be resolved through individual binding arbitration instead of in court, and waives class actions. Please read it.
 

1. Who we are

MUSKOX LLC designs and builds attachments for skid steers, tractors, and other loaders. Our office is at 33 S 3rd St, Ste D, Grand Forks, ND 58201, and our production facility is in Mentor, Minnesota. You can reach us at info@muskoxmn.com or 218-288-1905.
 

2. Who can use the Site

You must be at least 18 years old to use the Site. The Site is operated from the United States and intended for users in the United States and Canada. If you use it from somewhere else, you're responsible for following your local laws.
 

3. Product information, pricing, and promotions

We try to keep the Site accurate, but product information on it is general information, not an offer to sell.

  • Specifications, weights, dimensions, hydraulic requirements, and machine compatibility can change without notice. Photos and videos may show optional equipment or features that aren't on every unit.

  • Prices, promotions, availability, and delivery estimates can change at any time and may differ by country, dealer, and date. Prices are in U.S. dollars unless they're marked as Canadian dollars (CAD).

  • Promotions are valid only for the dates and terms stated with them. A promotion that has ended doesn't apply, even if it's still visible somewhere on the Site.

  • Financing is provided by third-party lenders, subject to their credit approval and terms. Payment examples on the Site are estimates.

  • If the Site contains an error in pricing, specifications, or availability, we may correct it at any time, including after you've requested a quote.
     

4. Quotes, orders, and warranties

The Site doesn't take orders. Quotes, orders, and purchases are governed by the quote or invoice we send you, our terms of sale, and the MUSKOX product warranty that applies to your product. If you buy through a dealer, your agreement with the dealer also applies. Nothing on the Site changes those terms or creates a warranty.
 

5. Equipment safety

MUSKOX attachments are heavy hydraulic equipment. Before you install, operate, or service one, read and follow the operator's manual that came with it and the requirements of your loader or tractor manufacturer, including limits on hydraulic flow, pressure, and lift capacity.

Videos, photos, articles, and support content on the Site are general information. They don't replace the operator's manual, proper training, or help from a qualified technician. Some show experienced operators in controlled conditions. If you're not sure how to do something safely, contact us or your dealer before you do it.
 

6. Our content and trademarks

The Site and everything on it, including text, photos, videos, graphics, logos, product designs, and software, belongs to MUSKOX or our licensors and is protected by copyright, trademark, patent, and other laws. MUSKOX and our product names and logos are trademarks of MUSKOX LLC. Some MUSKOX products are covered by patents.

You may view the Site and print or download pages for your own use in evaluating, buying, or using MUSKOX products. Dealers may use Site content to sell MUSKOX products as allowed by their dealer agreement. Any other use, including copying, republishing, or using our content or trademarks commercially, requires our written permission.
 

7. Acceptable use

When using the Site, you agree not to:

  • break any law, or help anyone else break one

  • submit false information or impersonate anyone

  • send spam, junk submissions, or automated form entries

  • scrape, crawl, or copy the Site or its content with bots or other automated tools, except for search engines indexing public pages

  • click our ads fraudulently or generate fake traffic

  • try to get into parts of the Site or our systems you're not authorized to access, or test them for vulnerabilities without our permission

  • upload viruses or other harmful code, or interfere with how the Site works

  • copy, reverse engineer, or resell any part of the Site

  • use the Site to build a competing product, or to collect information about our customers or dealers

  • harass, threaten, or abuse our staff through any form, chat, or message

We may block access for anyone who violates these rules.
 

8. Messages, calls, and texts

Your submissions

When you send us something through the Site, such as a form, message, review, photo, or suggestion, you confirm the information is accurate and that you have the right to share it. If you send us ideas or feedback about our products, we may use them without paying you or owing you anything.
 

Calls

Calls with MUSKOX may be recorded and transcribed for training, quality, and follow-up, as described in our Privacy Policy.
 

Text messages

If you give us your mobile number and agree to receive texts, MUSKOX may text you about your inquiries, quotes, orders, demos, and service. If you've separately agreed to marketing texts, we may also text you about products, promotions, and events.

  • Message frequency varies.

  • Message and data rates may apply.

  • Reply STOP to cancel. Reply HELP for help, or call 218-288-1905.

  • Agreeing to marketing texts is not a condition of buying anything.

  • Mobile carriers aren't liable for delayed or undelivered messages.

Electronic communications

You agree that we can communicate with you electronically, and that agreements, notices, and other communications we send electronically satisfy any legal requirement that they be in writing.
 

9. Third-party sites and tools

The Site links to, and uses tools from, other companies, including dealer websites, financing providers, maps, social media, and video platforms. We don't control those companies and aren't responsible for their content, products, or privacy practices. Your use of them is governed by their own terms.
 

10. Privacy

Our Privacy Policy and Cookie Policy explain how we collect and use information. They're part of these Terms.
 

11. Disclaimer

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, MUSKOX DISCLAIMS ALL WARRANTIES ABOUT THE SITE, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SITE WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, SECURE, OR FREE OF ERRORS OR VIRUSES.

This section applies to the Site only. Warranties for MUSKOX products are provided in the product warranty described in Section 4.
 

12. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, MUSKOX AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOST DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO THE AMOUNT, IF ANY, THAT YOU PAID US FOR USE OF THE SITE IN THE SIX (6) MONTHS BEFORE THE CLAIM AROSE.

Some states and provinces don't allow some of these limits. If their laws apply to you, some of these limits may not apply, and you may have additional rights.
 

Indemnity

If you misuse the Site or violate these Terms, and someone brings a claim against MUSKOX because of it, you agree to cover our resulting losses and costs, including reasonable attorneys' fees.
 

13. Disputes

Governing law

These Terms, and any dispute relating to the Site, are governed by the laws of the State of North Dakota, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods doesn't apply.

Try to resolve it with us first

Before starting arbitration or a lawsuit, contact us at info@muskoxmn.com and describe the problem. Both sides agree to try in good faith to resolve it informally for at least 30 days.

Binding arbitration

If we can't resolve a dispute informally, it will be decided by binding arbitration, not in court, except as described below. YOU AND MUSKOX EACH GIVE UP THE RIGHT TO SUE IN COURT AND TO A JURY TRIAL.

The arbitration will be run by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules and, where they apply, its Consumer Arbitration Rules (see adr.org). Your share of filing and arbitrator fees will be limited as the AAA Consumer Rules provide. Unless the AAA rules or the law require otherwise, the arbitration will take place in Grand Forks County, North Dakota. A court with jurisdiction may enter judgment on the arbitrator's award.

No class actions

Disputes will be arbitrated or heard only on an individual basis. Neither you nor MUSKOX may bring or take part in a class action, class arbitration, or representative action, and no arbitration may be combined with another without both sides' consent.

Exceptions

Either side may bring these in court instead of arbitration: claims in small claims court, claims to protect or enforce intellectual property rights, claims involving theft, piracy, invasion of privacy, or unauthorized use of the Site, and requests for injunctive relief.

Where court cases go

Any dispute that goes to court will be heard in the state or federal courts located in Grand Forks County, North Dakota, and you and MUSKOX consent to those courts' jurisdiction.

Time limit

Any claim relating to the Site must be brought within one (1) year after it arises, or it's permanently barred, unless the law requires a longer period.

If part of this section is unenforceable

If a court finds the class action waiver unenforceable for a particular claim, that claim will go to court, not arbitration. If any other part of this section is found unenforceable, the rest still applies.
 

14. Changes and termination

We may change or discontinue the Site, or any part of it, at any time without notice. We may also suspend or end your access if you violate these Terms.

We may update these Terms from time to time. The "Last updated" date at the top shows when we last changed them. Changes apply from the date they're posted, and your continued use of the Site means you accept them. Changes won't apply to a dispute we already knew about before the change was posted.
 

15. General terms

  • These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and MUSKOX about the Site. Quotes, invoices, terms of sale, warranties, and dealer agreements are separate agreements.

  • If any part of these Terms is unenforceable, the rest stays in effect.

  • If we don't enforce part of these Terms right away, we haven't given up the right to enforce it later.

  • You may not transfer your rights under these Terms. We may transfer ours, including as part of a sale or merger of our business.

  • We're not responsible for delays or failures caused by events outside our reasonable control.

  • Section headings are for convenience only.
     

16. California users

Under California Civil Code Section 1789.3, California users are entitled to the following notice: if you have a complaint about the Site that we haven't resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210.
